Diane DAiutolo is a partner at Tydings & Rosenberg LLP and has represented clients in a variety of litigation matters for over 27 years. She has extensive trial experience, litigating in both state and federal courts. Ms. DAiutolo represents hospitals, HMOs, and other health care providers in litigation and serves as outside general counsel to several physician practices, counseling them in connection with risk management, HIPAA compliance, medical negligence cases, and regulatory and transactional matters.

Greg Garrett is an associate at Tydings & Rosenberg LLP, specializing in the defense of health care providers. He has represented health care clients in numerous proceedings in Maryland courts, as well as state and federal administrative agencies. He is a 2005 graduate of the University of Baltimore School of Law, and a member of the Heuisler Honor Society.

Description
In recent years, more and more states have recognized claims for negligent credentialing. Judgments and settlements in these cases can be huge, and the inclusion of a claim for negligent credentialing can put the health care provider at a tactical disadvantage. This presentation provides an overview of the states that recognize negligent credentialing claims, those that do not, and those that are likely to recognize such claims in the future. The common elements of such claims are explored, as are potential defenses. Real world examples from reported court decisions will be presented, and suggested best practices will be provided.
