Michael R. Callahan has been a practicing health care attorney for 30 years, assisting hospital and health system clients on a variety of health care legal issues including Patient Safety Organizations, quality improvement, ACOs, peer review, health care antitrust, HIPAA and regulatory compliance, accreditation matters and general corporate, medical staff credentialing, hospital/medical staff relations, and mergers and acquisitions. Mr. Callahan recently participated in the NAHQ Task Force and their "Call to Action" addressing the need to protect health care workers engaged in monitoring and reporting patient care issues and problems to their superiors.
Ms. Porto has extensive experience in patient safety and is a nationally recognized expert in this field, having served as President of the American Society for Healthcare Risk Management (ASHRM) and on the Board of Directors of the National Patient Safety Foundation. She currently serves on The Joint Commissions Patient Safety Advisory Group. Ms. Porto has worked with a broad range of healthcare organizations and providers, from large hospital systems and insurers to individual providers and organizations. Ms. Porto has worked with DuPont Sustainable Solutions on the development of healthcare compliance training products.

NAHQ members are concerned about recent cases of retaliation and at least one case of criminal prosecution of healthcare quality professionals who were taking appropriate action to address significant clinical quality concerns consistent with their job responsibilities. Intimidation, retaliation against or prosecution of healthcare quality professionals who, in the course of performing their job functions, seek to remedy significant quality issues has a profound and deleterious effect on the healthcare system. This session will discuss the findings and recommendations of the NAHQ Ethical Dilemmas Task Team. Additionally, recommendations from the Team's collaboration with other stakeholders will be discussed.
