This workshop is not intended to serve as legal advice or interpretation of the law. It is the summation of best practice methods of quality control processes and personal experience gathered from years in business. The workshop looks at various reasons business brokers are dragged into lawsuits and how adopting an effective quality control procedure can help minimize liability. As a certified government underwriter, the presenter encourages sole practitioners and multi-agent firms to implement an effective quality control system emphasizing "court room ready" files, adequately documenting the distribution of disclosures, phone calls, correspondence, e-mails and marketing efforts in the selling of a business. Various types of disclosures essential in a transaction are discussed along with the importance of adopting systematic methods for their introduction throughout the transaction process. Whether representing a seller, a buyer or both, disclosures are essential to minimizing liability.
